General terms and conditions of business
Section 1 Scope, Customer Information
The following terms and conditions govern the contractual relationship between Atelier Jörg Minrath and consumers and businesses that purchase goods through our online shop. We do not recognize any conflicting or deviating terms and conditions. The contract language is German.
§ 2 Conclusion of Contract
(1) The offers on the Internet constitute a non-binding invitation to you to purchase goods.
(2) You can place one or more products in your shopping cart. During the ordering process, you will enter your details and preferences regarding payment method, delivery options, etc. Only by clicking the order button do you submit a binding offer to conclude a purchase agreement.
(3) The confirmation of receipt, which is sent immediately by e-mail, also constitutes acceptance of the offer and thus concludes the purchase contract.
Section 3 Customer Information: Storage of your order data
Your order, including details of the concluded contract (e.g., product type, price, etc.), will be saved by us. However, you do not have online access to your past orders. We will send you the Terms and Conditions, but you can also access them at any time on our website. If you wish to save the product description from our shop page for your own records, you can, for example, take a screenshot at the time of ordering or print the entire page.
Section 4 Customer Information: Correction Notice
You can correct your entries at any time before submitting your order using the delete key. We will inform you about further correction options during the ordering process. You can also cancel the ordering process completely at any time by closing the browser window.
§ 5 Retention of Title
The purchased item remains our property until full payment is received.
§ 6 Statutory Warranty Rights
(1) Warranty rights
Our goods are subject to statutory warranty rights.
(2) Warranty for consumers in the case of used goods
Your warranty claims for defects in used goods expire one year after delivery of the goods to you. Excluded from this provision are claims for damages, claims for defects that we fraudulently concealed, and claims arising from a guarantee we have given for the condition of the goods. The statutory limitation periods apply to these excluded claims.
(3) Warranty towards entrepreneurs
Your warranty claims for defects in the goods expire one year after the transfer of risk. Excluded from this provision are claims for damages, claims for defects that we have fraudulently concealed, and claims arising from a guarantee that we have given for the quality of the goods. Also excluded is the right of recourse under Section 478 of the German Civil Code (BGB). The statutory limitation periods apply to these excluded claims.
§ 7 Limitation of Liability
We exclude liability for breaches of duty caused by slight negligence, unless these breaches concern essential contractual obligations, damages resulting from injury to life, body, or health, guarantees, or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and legal representatives. Essential contractual obligations include, in particular, the obligation to deliver the goods to you and to transfer ownership to you. Furthermore, we are obligated to provide you with goods free from material and legal defects.
§ 8 Commercial Jurisdiction
The exclusive place of jurisdiction for all disputes arising from this contract is our place of business, if you are a merchant.
